Terms of Service

1. What ViewHaven is

ViewHaven is a parental-control app that lets a parent or guardian choose the YouTube channels their children may watch, and gives children a curated, supervised viewing experience. ViewHaven is designed to be set up and controlled by a parent or guardian. Children do not create their own accounts and cannot change any settings.

2. Who can use ViewHaven

• You must be at least 18 years old, or the age of majority in your jurisdiction, and the parent or legal guardian of any child who uses a device set up through your ViewHaven account, to set up and manage ViewHaven.
• Children use ViewHaven only within the profile(s) and settings a parent or guardian configures for them, under that parent's or guardian's supervision and consent. ViewHaven does not knowingly collect personal information directly from children - see our Privacy Policy.
• By creating a profile for a child, you confirm you are that child's parent or legal guardian, or otherwise have the legal authority and consent required to do so.

3. Accounts

• Creating an adult account (email and password) is optional and is used to back up and restore your family setup across devices. You can use the core app without one.
• You're responsible for keeping your account credentials and parental passcode/PIN confidential, and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it up to date.
• We may suspend or terminate an account that we reasonably believe is being used in violation of these Terms, to protect the Service, or as required by law.

4. Subscriptions - ViewHaven Plus

• Free tier: approved-channel viewing, a parent PIN, and one child profile are always free - no payment is required to let a child watch approved content.
• ViewHaven Plus is an optional paid subscription that unlocks additional parental-control features (multiple child profiles, Family Sync, schedules, screen-time limits, watch history, remote lock, blocked keywords/videos). A free trial may be offered; trial length, pricing, and renewal terms are shown to you before you subscribe.
• Billing is handled entirely by the app store - Google Play or the Apple App Store - under that store's terms. We do not process or store your payment card details.
• Subscriptions automatically renew at the price shown at purchase, unless cancelled at least 24 hours before the end of the current period, through your Google Play or Apple App Store account.
• Refunds and cancellations are handled according to the applicable app store's policy, not by Conda Technology directly.
• Purchases require passing a parental gate (a randomised challenge) before a subscription can be started, so a child cannot purchase Plus on their own.
• We may change ViewHaven Plus pricing or features going forward; changes will not retroactively affect an active billing period without notice as required by the applicable app store or law.

5. Third-party content - YouTube

ViewHaven displays video content from YouTube, retrieved via YouTube API Services and played through YouTube's official embedded player.

• ViewHaven is not affiliated with, endorsed by, or sponsored by YouTube or Google.
• By using ViewHaven, you also agree to the YouTube Terms of Service, and Google's handling of data is described in the Google Privacy Policy.
• We do not control, and are not responsible for, the content of videos or channels made available on YouTube, even when approved by a parent. Parents are responsible for reviewing and approving the channels added to a child's profile.
• ViewHaven does not download, rip, or re-host YouTube video streams; playback occurs through YouTube's own player.
• ViewHaven's paid features (ViewHaven Plus) pay for our own parental-control software - not for access to YouTube content or API data. Watching approved content is always free.

6. Acceptable use

You agree not to:

• Use ViewHaven for any unlawful purpose, or in a way that violates the rights of any third party (including a child's privacy or safety);
• Attempt to circumvent, disable, or interfere with ViewHaven's parental controls, security features, or content restrictions;
• Reverse-engineer, decompile, or attempt to extract the source code of the app, except where permitted by law;
• Use automated means (bots, scrapers) to access the Service or the proxy that serves YouTube data;
• Misrepresent your identity or relationship to a child when creating a profile;
• Interfere with or disrupt the Service, its servers, or its networks.

We may suspend or terminate access for any account that violates this section.

7. Intellectual property

• ViewHaven's app, branding, logo, and website content are owned by Conda Technology or its licensors and are protected by applicable intellectual property laws.
• YouTube video content remains the property of its respective creators and YouTube/Google.
• These Terms do not grant you any right to use Conda Technology's trademarks or branding without our prior written consent.

8. Disclaimers

• ViewHaven is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
• We do not guarantee that ViewHaven will be uninterrupted, error-free, or that Family Sync, time limits, or content filters will operate without fault in every circumstance. ViewHaven is a supervisory aid, not a substitute for active parental supervision.
• We do not guarantee the availability, accuracy, or appropriateness of any specific YouTube content, even when approved by a parent - content on YouTube can change or be removed by its creator or by YouTube at any time.

9. Limitation of liability

To the maximum extent permitted by applicable law, Conda Technology and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of, or inability to use, the Service - even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us, if any, in the 12 months before the claim arose.

Nothing in these Terms limits any liability that cannot be limited or excluded under applicable law.

10. Indemnification

You agree to indemnify and hold Conda Technology harmless from any claims, losses, or damages, including reasonable legal fees, arising from your violation of these Terms, your misuse of the Service, or your violation of any rights of a third party (including a child in your care).

11. Termination

• You may stop using ViewHaven at any time, and may delete your account and data as described in our Account Deletion page.
• We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if we discontinue the Service.
• Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will survive.

12. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice. Continued use of ViewHaven after an update means you accept the revised Terms. If you do not agree to updated Terms, stop using the Service.

13. Governing law

These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles, except where applicable local consumer-protection law requires otherwise for your jurisdiction.
